3. Equipment Rental and Use

(b) Proper Use: You agree to use the rented equipment only for its intended purpose and in accordance with any instructions or guidelines provided by the Company. You are responsible for ensuring that the equipment is used safely and in compliance with all applicable laws and regulations.

(c) Return of Equipment: You agree to return the rented equipment to the Company in the same condition as it was received, normal wear and tear excepted, by the end of the rental period.

4. Liability and Indemnification

(a) Limitation of Liability: IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR RENTAL OF EQUIPMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) Indemnification: You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service or rental of equipment, your violation of this Agreement, or your violation of any rights of any third party.
